Authorizations and Prohibitions in the Field of CBD by Expertox

The decree of December 30, 2021 implementing article R. 5132-86 of the public health code concerning the cultivation, import, export and industrial and commercial use of hemp extracts, comes to appear!

This specifies the authorizations and prohibitions in this area. Major regulatory changes refer to it in particular (non-exhaustive list):

  • The extension of the authorization of “the cultivation, importation, exportation and industrial and commercial use” of authorized hemp varieties to all parts of the hemp plant, no longer only to fibers and seeds;
  • Flowers and hemp leaves may not be sold to consumers in their raw form (such as “smoking flowers” or herbal teas), this prohibition being justified for reasons of health and public order;
  • An extension of the authorized varieties of hemp in France to those listed in the European catalog and an increase in the maximum rate of THC to 0.3%, in the whole plant (common catalog of varieties of agricultural plant species).
